these terms & conditions apply to all orders placed through the online shop of:

these terms apply to consumers and business customers, unless otherwise stated.
a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
a business customer is any natural or legal person or partnership with legal capacity who acts in the course of their trade, business or profession when entering into a legal transaction.
2. products
pelias solutions sells specialized reptile tools, handling tools, enclosure systems, artificial rock products, texture molds, field gear and related products.
product images, descriptions, dimensions and specifications are provided as accurately as possible. minor deviations may occur, especially for handmade, hand-finished or custom-made products.
handmade products may show small variations in finish, surface, shape or appearance. these variations do not constitute a defect as long as the product remains suitable for its intended use.
3. safety information
our products are intended for responsible reptile keeping, field work, enclosure building and related professional or hobby use.
working with reptiles, especially venomous, dangerous, strong or legally regulated species, requires proper knowledge, experience, safety protocols and legal permissions.
our products do not replace training, professional knowledge, legal compliance or responsible handling practices.
the customer is responsible for checking whether the product is suitable for their intended use and whether the possession or use of such product is permitted in their country or region.
4. conclusion of contract
the presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
by clicking the final order button at checkout, you place a binding order for the products in your cart.
after placing your order, you will receive an automatic order confirmation by email. this confirmation documents that we have received your order.
the contract is concluded when we accept your order, usually by sending an order confirmation, shipping confirmation or by dispatching the goods.
we reserve the right to refuse or cancel orders where products are unavailable, payment cannot be processed, shipping is not possible, or there are obvious errors in product information or pricing.
5. prices
all prices are shown in the currency displayed in the online shop and include applicable taxes where legally required.
shipping costs, customs duties, import taxes and other additional charges are shown separately where applicable or described in our shipping policy.
for deliveries outside the european union, additional customs duties, import taxes, vat, handling fees or other charges may apply. these charges are the responsibility of the customer.
6. payment
available payment methods are shown during checkout.
payment may be processed through third-party payment providers such as shopify payments, paypal, credit card providers, apple pay, google pay or other available services.
we reserve the right to offer or exclude certain payment methods depending on the order, destination or technical availability.
7. delivery and shipping
shipping areas, shipping costs and estimated delivery times are described in our shipping policy.
delivery times are estimates and may vary due to customs, carrier delays, public holidays, weather conditions, product availability or other circumstances outside our control.
for custom-made products, artificial rock products, molds, special sizes or made-to-order items, additional production time may apply. the estimated production time will be stated on the product page or communicated separately.
8. customs, duties and import regulations
for orders shipped outside the european union, the customer is responsible for any customs duties, import taxes, vat, handling fees or other charges imposed by the destination country.
the customer is also responsible for checking whether the ordered products may be imported, owned or used in their country or region.
pelias solutions is not responsible for delays, additional costs, confiscation or failed delivery caused by customs procedures, import restrictions or incorrect information provided by the customer.
9. retention of title
the goods remain the property of pelias solutions until full payment has been received.
10. right of withdrawal for consumers
consumers have a statutory right of withdrawal as described in our separate right of withdrawal policy.
the right of withdrawal does not apply or may expire early in certain cases, including custom-made products, products manufactured according to customer specifications, personalized products and certain digital content, as described in the right of withdrawal policy.
business customers do not have a statutory right of withdrawal unless expressly agreed otherwise.
11. returns
returns must be handled according to our right of withdrawal policy and any additional instructions provided by us.
customers must return products in suitable packaging and are responsible for ensuring that returned goods are properly protected during transport.
12. digital products
digital products, downloads, templates, documents or other digital content may be made available after purchase by email, download link or customer account.
for digital content that is not supplied on a physical medium, the right of withdrawal may expire early if the customer expressly agrees that performance begins before the end of the withdrawal period and acknowledges that they thereby lose their right of withdrawal.
13. custom-made products
custom-made products, made-to-order items, personalized products, custom artificial rock products, custom molds, custom sizes and products manufactured according to customer specifications are produced specifically for the customer.
such products may be excluded from the consumer right of withdrawal where legally permitted.
the details, dimensions, materials, design and production scope of custom products must be agreed before production begins.
14. legal warranty
consumers are entitled to statutory warranty rights under applicable law.

if a product is defective, please contact us as soon as possible with your order number, a description of the issue and photos where helpful.
damage caused by improper use, excessive force, unsuitable use, modification, lack of maintenance, normal wear and tear or disregard of safety information is not considered a product defect.
15. liability
we are liable without limitation for damages caused by intent or gross negligence, for injury to life, body or health, and where liability is mandatory under applicable law.
in other cases, our liability is limited according to statutory provisions.
we are not liable for damage caused by improper use of our products, unsafe reptile handling, lack of experience, violation of legal requirements or use outside the intended purpose of the product.
16. product availability
products may be available only in limited quantities.
if a product is unavailable after an order has been placed, we will inform you and may offer a replacement, delayed delivery or refund.
17. intellectual property
all content on this website, including texts, images, logos, product names, designs, graphics and product descriptions, is protected by copyright, trademark or other intellectual property rights where applicable.
use, reproduction, editing, distribution or commercial use without our written permission is not permitted.
18. customer accounts
customers may have the option to create an account.
customers are responsible for keeping their login details confidential and for ensuring that the information provided is correct and up to date.
19. governing law
these terms & conditions are governed by the laws of the federal republic of germany.
for consumers, mandatory consumer protection laws of the country in which the consumer has their habitual residence remain unaffected, where applicable.
20. dispute resolution
we are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
21. severability
if any provision of these terms & conditions is or becomes invalid, the validity of the remaining provisions remains unaffected.
